By accessing or using the website located at www.lucidjiujitsu.com (the "Site"), or by enrolling in, attending, or otherwise participating in any class, program, event, or service offered by Lucid Jiu Jitsu ("the Academy," "we," "us," or "our"), you ("you," "your," or "Participant") acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"), along with our Privacy Policy, which is incorporated herein by reference.
If you do not agree to all of these Terms, you must not access the Site or participate in any Academy services. These Terms apply to all visitors, students, members, guests, parents, and guardians who interact with the Academy in any capacity.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or participation in Academy services following any such modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Lucid Jiu Jitsu is a martial arts academy located at 1439 Broadway, Hewlett, NY 11557. The Academy offers instruction and training in the following disciplines and programs:
The Academy reserves the right to modify, suspend, or discontinue any program, class, schedule, or service at any time, for any reason, with or without notice. We also reserve the right to refuse enrollment, membership, or access to the Academy's facilities or programs to any individual, at our sole discretion.
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
You acknowledge and understand that Brazilian Jiu Jitsu, wrestling, grappling, and all related martial arts disciplines are contact sports that involve vigorous physical activity. Participation carries inherent and significant risks of physical injury, including but not limited to:
These risks exist regardless of the skill level of the Participant or training partners, the quality of instruction, or the condition of the facilities. No amount of care, caution, or supervision can eliminate these inherent risks.
By enrolling in or attending any class, session, open mat, seminar, or other training activity at Lucid Jiu Jitsu, you voluntarily and knowingly assume all risks — known and unknown, foreseen and unforeseen — associated with martial arts training, including all risks described in Section 3.1 above and any others not specifically enumerated herein. This assumption of risk applies to all activities conducted on the Academy's premises, on third-party premises, and at any off-site events organized or co-organized by the Academy.
To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Lucid Jiu Jitsu, its owners, operators, partners, instructors, coaches, employees, agents, volunteers, and independent contractors (collectively, "Released Parties") from any and all liability, claims, demands, losses, damages, costs, and expenses — including attorneys' fees — arising out of or related to any injury, illness, death, property damage, or other harm sustained by you in connection with your participation in any Academy activity, whether caused by the negligence of any Released Party or otherwise.
This release includes, without limitation, claims arising from:
We strongly recommend that all Participants, particularly those with pre-existing medical conditions, obtain clearance from a licensed physician before beginning any martial arts training program. By participating, you represent that you are in sufficiently good health to engage in vigorous physical activity and that you are not aware of any medical condition that would make participation inadvisable or dangerous. If you experience any pain, dizziness, shortness of breath, or discomfort during training, you agree to stop immediately and seek appropriate medical attention.
If you are enrolling a minor (any individual under 18 years of age) in any Academy program, you represent that you are the minor's parent or legal guardian. By completing enrollment, you consent on behalf of the minor to all terms set forth in these Terms, including this Section 3. You further agree that this release, waiver, and assumption of risk applies to the minor Participant to the fullest extent permitted by New York law, and that you assume all risks of injury or harm associated with the minor's participation on the minor's behalf.
The Academy reserves the right to refuse, suspend, or terminate the participation of any individual — including enrolled members — at any time and for any reason, including but not limited to unsafe behavior, violation of the Code of Conduct set forth in Section 6, or if the Academy determines in its sole judgment that continued participation poses a risk to the individual or others.
Enrollment in a recurring membership program constitutes an agreement to pay the applicable monthly or periodic membership fee. Membership fees are due on the date specified at the time of enrollment and recur automatically on the same date each billing period unless cancelled in accordance with the cancellation policy below.
All recurring memberships automatically renew at the end of each billing period at the then-current membership rate. You authorize the Academy to charge your payment method on file for each renewal period until you cancel. We will not provide advance notice of each individual auto-renewal charge, though we may notify you of any changes to membership pricing in advance of those changes taking effect.
You may cancel your membership at any time by providing written notice to the Academy via email at admin@lucidjiujitsu.com or in person at the Academy's front desk. To avoid being charged for the following billing period, cancellation requests must be received at least seven (7) calendar days prior to your next scheduled billing date. Cancellations received fewer than seven days before the renewal date will take effect at the end of the following billing period. Membership access continues through the end of the paid billing period.
All membership fees are non-refundable except as required by applicable law. The Academy does not issue prorated refunds for partial months of use, cancelled memberships, or missed classes. Unused class credits or sessions do not roll over between billing periods unless expressly stated otherwise in writing at the time of purchase. If you believe an erroneous charge has been applied to your account, please contact us within thirty (30) days of the charge at admin@lucidjiujitsu.com.
The Academy uses Stripe, Inc. ("Stripe") to process payments. By providing your payment information, you agree to Stripe's Terms of Service and Privacy Policy, available at stripe.com/legal. The Academy does not store your full credit card number or payment card details on its own servers. All payment data is handled and encrypted by Stripe in accordance with PCI-DSS standards. You are responsible for ensuring your payment information on file remains current and accurate.
The Academy reserves the right to modify membership fees at any time. You will receive at least thirty (30) days' advance written notice of any price increase before it takes effect on your account. Continued participation in your membership after the effective date of a price change constitutes acceptance of the new pricing.
All Participants — including students, members, guests, and visitors — are expected to conduct themselves in a manner consistent with the values of respect, integrity, and sportsmanship that are fundamental to the martial arts. By participating in any Academy activity, you agree to abide by the following standards:
The Academy reserves the right to terminate or suspend any membership or participation privilege, without refund, for any violation of this Code of Conduct or for any other conduct that the Academy determines, in its sole discretion, to be harmful, disruptive, or incompatible with the Academy's community standards.
Lucid Jiu Jitsu may offer SMS text message communications for purposes including, but not limited to: class schedule updates, schedule change notifications, promotional offers, event announcements, membership reminders, and general Academy communications (the "SMS Program").
By providing your mobile phone number to the Academy and affirmatively opting in to receive text messages — whether through an online form, an in-person enrollment form, or by texting a keyword to an Academy shortcode or long code — you expressly consent to receive recurring automated or manually dialed text messages from or on behalf of Lucid Jiu Jitsu at the mobile number you provide. Consent to receive marketing text messages is not a condition of purchasing any goods or services from the Academy.
Message frequency will vary. You may receive periodic messages related to class schedules, promotions, events, and general Academy updates. Frequency depends on your enrollment status, upcoming events, and your interaction with the Academy.
You may opt out of the SMS Program at any time by replying STOP to any text message you receive from us. After texting STOP, you will receive one final confirmation message acknowledging your opt-out, and you will no longer receive marketing text messages from the Academy. To re-enroll, you may text START to the same number.

Message and data rates may apply. Standard messaging and data rates from your wireless carrier will apply to all text messages sent and received. The Academy is not responsible for any charges imposed by your carrier. Check your mobile plan for applicable rates. Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, and US Cellular. Carrier support may vary.
Mobile number and opt-in data will not be shared with third parties for their marketing purposes. For additional information, please review our Privacy Policy.
All content on the Site and in any Academy marketing materials — including, without limitation, text, graphics, photographs, video recordings, audio recordings, logos, trademarks, service marks, trade dress, training methodologies, curriculum materials, class formats, and the overall look and feel of the Site — is the exclusive property of Lucid Jiu Jitsu or its respective licensors and is protected by United States and international copyright, trademark, and intellectual property laws.
The Academy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include the right to: (a) modify or create derivative works based on any Site content; (b) reproduce, distribute, perform, display, or transmit any Site content for commercial purposes; (c) scrape, data-mine, or use automated tools to collect Site content; or (d) use any Academy trademarks, logos, or branding in any manner without prior written consent.
You may not reproduce, republish, copy, sell, resell, license, sublicense, or exploit for any commercial purpose any portion of the Site content or Academy materials without the express prior written permission of Lucid Jiu Jitsu. Unauthorized use of any Academy intellectual property may give rise to a claim for damages and may constitute a criminal offense.
If you submit, upload, post, email, or otherwise make available to the Academy any photographs, videos, testimonials, reviews, comments, or other content ("User Content") — including but not limited to content submitted through social media, online forms, or in person — you hereby grant Lucid Jiu Jitsu a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such User Content in any and all media now known or hereafter developed, for any lawful purpose, including without limitation for marketing, advertising, and promotional purposes, without compensation to you.
By submitting User Content, you represent and warrant that: (a) you own or have the necessary rights to the User Content and to grant the license described above; (b) the User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; and (c) the User Content does not contain any material that is defamatory, obscene, unlawful, or otherwise objectionable.
The Academy reserves the right, but has no obligation, to review, edit, or remove any User Content at its sole discretion and without notice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUCID JIU JITSU OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, YOUR PARTICIPATION IN ANY ACADEMY PROGRAM OR ACTIVITY, OR THESE TERMS, EVEN IF THE ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT THE ACADEMY'S LIABILITY CANNOT BE FULLY DISCLAIMED UNDER APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LUCID JIU JITSU AND THE RELEASED PARTIES TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PARTICIPATION IN ACADEMY SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL MEMBERSHIP FEES PAID BY YOU TO THE ACADEMY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full.
You agree to defend, indemnify, and hold harmless Lucid Jiu Jitsu and the Released Parties from and against any and all claims, actions, demands, losses, liabilities, costs, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your use of the Site or participation in any Academy activity; (b) your violation of these Terms; (c) your violation of any applicable law, rule, or regulation; (d) any User Content you submit; (e) your infringement of any third-party intellectual property, privacy, or other rights; or (f) injury or property damage caused to any third party as a result of your conduct at or in connection with the Academy.
The Academy reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with the Academy in asserting any available defenses.
These Terms and all matters arising out of or relating to your use of the Site or participation in Academy services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Academy's services shall be brought exclusively in the state or federal courts located in Nassau County, New York. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue in such courts.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE ACADEMY EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PARTICIPATION IN ACADEMY SERVICES.
Any claim or cause of action you may have arising out of or related to these Terms or your use of the Academy's services must be filed within one (1) year after such claim or cause of action arose. Claims filed after this period are permanently barred, regardless of any statute of limitations to the contrary.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any one provision shall not affect the validity or enforceability of any other provision, and the remaining provisions of these Terms shall continue in full force and effect.
These Terms, together with our Privacy Policy and any membership agreement, enrollment form, or liability waiver executed by you in connection with your participation in Academy services, constitute the entire agreement between you and Lucid Jiu Jitsu with respect to your use of the Site and participation in Academy programs, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
Any failure by the Academy to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term or condition shall be deemed a continuing waiver of such term or condition or any other term or condition.
The Academy reserves the right to revise, update, or replace these Terms at any time in its sole discretion. When we make material changes to these Terms, we will update the "Last updated" date at the top of this page. We may also notify you of significant changes by email or by posting a notice on the Site. Your continued use of the Site or continued participation in Academy services after the effective date of any revised Terms constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Site and discontinue your participation in Academy services.
